Welcome to whisperify, a web3-based social software that allows you to share your voice and ideas with friends and strangers around the world. whisperify is developed and operated by the whisperify team("we" or " Whisperify " is developed and operated by the whisperify team ("we" or " whisperify"). These Terms of Service ("Terms") set forth the conditions and limitations of your use of the software and services of whisperify ("Services"). Please read and understand these Terms carefully as they constitute a legal agreement between you and

1. Acceptance of terms

By registering for, accessing or using our services, you agree to abide by the Terms. If you do not agree to the Terms, please do not use our services. We reserve the right to modify or update the Terms at any time and without prior notice to you. Any modifications or updates will be effective immediately upon posting by us and will apply to all subsequent use of the Services by you. Therefore, we recommend that you periodically review the Terms for any changes. Your continued use of our Services will signify your acceptance of the modified or updated Terms.

2. Use of our services

In order to use our services, you must fulfil the following conditions:

  • You must be 13 years of age or older and have full capacity for civil behaviour and civil liability;
  • You must have a valid web3 wallet or our inbuilt wallet through which you interact with our Services;
  • You must comply with these Terms and all laws, rules and regulations applicable in your area.

3. Accounts and security

When you use our services, you are required to authenticate and authorise yourself through web3 wallet. We do not store or collect sensitive information such as your private key, mnemonic or password. Therefore, it is your responsibility to protect your web3 Wallet and to back up the information properly. If you lose the ability to access your web3 Wallet, or if your web3 Wallet is stolen, damaged or deleted, you may no longer be able to access or use our Services and may lose all data and assets associated with your web3 Wallet. In such cases, we cannot provide you with any assistance or compensation. Therefore, please take care of your web3 wallet and avoid disclosing it to any third party.

4. Content and behaviour

When you use our Services, you may create, upload, post, send, receive, and store a variety of content, including, but not limited to, text, images, audio, video, etc. (collectively, "Content"). You are solely responsible for the Content you provide and you acknowledge and agree that:

  • You own all rights, licences and permissions necessary to provide the Content;
  • The content you provide does not violate any applicable laws, rules and regulations or infringe on the rights or interests of any third party;
  • The content you provide does not contain any content that is unlawful, obscene, pornographic, violent, terrorist, hateful, discriminatory, defamatory, harassing, fraudulent, threatening or encourages any of these behaviours;
  • The content you provide does not contain any viruses, Trojan horses, worms or other harmful or destructive code or programs;
  • The content you provide does not contain any advertising, sales pitches, spam or other unwanted messages.

We do not audit, monitor or review the content provided by you or any third party, and are not responsible for its quality, accuracy, completeness or reliability. However, we reserve the right to remove, block or disable access to any Content at any time for any reason without prior notice to you. If you become aware of any content that violates these Terms or infringes your rights, please report it to us promptly.

When you use our services, you are also subject to the following code of conduct, which you acknowledge and agree to:

  • You will not interfere with, disrupt or affect the proper functioning of our Services or attempt to bypass any security measures or limitations of our Services;
  • You will not use our services for any unlawful, immoral or improper purpose, nor will you use our services to engage in any illegal, infringing or fraudulent activity;
  • You will not impersonate any person or entity, nor will you fictionalize your relationship with any person or entity;
  • You will not violate or damage our or any third party's rights or interests, including, but not limited to, intellectual property rights, privacy rights, and rights of reputation;
  • You will not harass, threaten, intimidate, abuse or malign us or any third party;
  • You will not collect, store or disclose personal information about us or any third party unless you have their express consent;
  • You will not violate any applicable laws, rules and regulations other than these Terms.

If you violate the above content and code of conduct, we have the right to take all reasonable and necessary measures, including, but not limited to, deleting the content you provide, suspending or terminating your right to use our services, reporting your behavior to the relevant authorities, and pursuing legal liability against you.

5. Our rights to services

We reserve all rights in and to our Services, including, without limitation, all intellectual property and other proprietary rights. You may not reproduce, modify, distribute, sell, lease, transfer, license, or otherwise use any portion of our Services except with our express written consent. You also may not reverse engineer.

The Software or Services may contain links to third-party websites or resources, or services provided by third parties. These links and services are provided solely as a convenience to you and do not imply our endorsement, support or sponsorship of such third party websites, resources or services. You should make your own judgment and assessment of the availability, safety and legality of these third-party websites, resources or services and bear all risks associated with them. We are not responsible for these third-party websites, resources or services or their content and are not liable for any loss or damage arising from the use of these third-party websites, resources or services.

7. Disclaimer

the software and services are provided "as is" and "as available" without warranty of any kind, either express or implied. we do not warrant that the software and services will meet your requirements or that the software and services will be error-free, uninterrupted, uninterrupted, uninterrupted, free of delays, free of defects, free of viruses or secure. all risks arising from your use of the software and services are assumed by you. to the fullest extent permitted by applicable law, we expressly exclude all warranties, express or implied, provided by law.

8. Compensation

You agree to indemnify and hold us and our affiliates, directors, officers, employees, and agents harmless from any claims, liabilities, losses, and expenses (including attorneys' fees) arising from

to the maximum extent permitted by applicable law, we will not be liable for any direct, indirect, special, incidental, punitive or consequential damages (including, without limitation, lost profits, lost data, damage to goodwill, or other intangible losses) arising out of the use of, or the inability to use, the software or the services, even if we have been advised of the possibility of such damages. in no event shall our total liability for any claim under this section exceed the amount of fees, if any, paid to us by you during your use of the software or services.
